If there is a marital home, it will need to be decided who gets to keep it or whether it needs to be sold. Also, if it is decided that selling the home is the best course of action, you will want to talk with your attorney about how much money you will be able to get from the sale. Generally, any liens against the property will be paid off first and then the remaining money will be divided as agreed upon. This is not always an equal split between the two people. For example, if you have proof that you just put in thousands of dollars of work to remodel the home for the sale, you might want to ask to recoup that first and then the remaining profit can be split.

Custody And Visitation Schedule For The Kids

If there are minor children, there needs to be a legal custody agreement and visitation schedule in place, even if you and your soon-to-be ex-spouse have agreed upon things. Failing to have such information legally noted can result in major problems should one parent decide that they no longer want to stick with the agreed-upon decision. By having such things in writing and approved by a judge, you will not be as likely to have to deal with parental kidnapping in the future.

Communication Between The Two Of You

It is great if you and your spouse are able to speak on good terms while the details of the divorce are being worked out. However, there may be times in which this is not so easy to do. In some cases, it is actually better to simply let the attorneys discuss things between each other and keep the clients from talking to each other. This is best in cases where one or both people are abusive or there is a lot of arguing concerning matters surrounding the divorce or the reason for the divorce.

The sooner you retain a divorce lawyer, the better. This way, they will have ample time to review your case and figure out a plan of action.
